1. Acceptance of these terms
These Terms of Use (“Terms”) govern your use of the mobile applications and games published by Pusulart Studio and the website at pusulartstudio.com (together, the “Services”), provided by Sonmez LLC (operating as Pusulart Studio), 30 N Gould St Ste 28906, Sheridan, WY 82801, USA (“we”, “us”, “our”). By downloading, accessing or using the Services you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Services. Some Apps may have additional terms, which form part of these Terms.
2. Eligibility
You must be at least 13 years old (or the minimum age of digital consent in your country) to use the Services. Features that involve buying or selling require you to be at least 18 and able to enter into a binding contract. If you use the Services on behalf of an organization, you confirm you are authorized to bind it.
3. Accounts
Some features require an account. You agree to provide accurate information, keep your credentials secure and notify us promptly of any unauthorized use. You are responsible for activity under your account. You may delete your account at any time as described on our account deletion page.
4. License to use the Services
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download and use the Apps on devices you own or control, for your personal, non-commercial use (except where an App expressly supports commercial use, such as selling items on a marketplace). You may not copy, modify, distribute, sell, lease, reverse engineer or attempt to extract the source code of the Services, except as permitted by law.
5. Your content
You keep ownership of content you submit, such as listings, photos, messages and reviews (“User Content”). You grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, adapt (for example, resize images) and distribute your User Content solely to operate, promote and improve the Services. This license ends when you delete the content or your account, except for content shared with others that they still hold, or copies we must keep for legal reasons.
You are responsible for your User Content and confirm you have the rights to post it and that it does not violate the law or anyone’s rights. We may remove content that violates these Terms.
6. Marketplace features
Where an App lets users list, buy or sell items (for example drones, cameras and related equipment), we provide the platform only. Unless expressly stated otherwise, we are not a party to transactions between users, do not own or inspect listed items, and do not guarantee their quality, safety, legality, or the accuracy of listings. Sellers are responsible for accurate descriptions, lawful sale and compliance with applicable laws — including aviation, export-control, and consumer-protection rules. Buyers are responsible for verifying items and for compliance with local regulations on drone registration and operation. Please report suspicious listings or users to [email protected].
7. Acceptable use
You agree not to:
- break any law or infringe anyone’s intellectual property, privacy or other rights;
- list or sell prohibited, stolen, counterfeit or illegal items;
- post content that is fraudulent, misleading, harassing, hateful, sexually explicit or violent;
- spam, scam or impersonate any person or entity;
- interfere with or disrupt the Services, or access them using bots, scrapers or other automated means without our permission;
- attempt to gain unauthorized access to accounts, systems or data;
- cheat, exploit bugs or use unauthorized third-party software in our games.
8. Purchases and subscriptions
In-app purchases and subscriptions are processed by Apple or Google under their terms. Subscriptions renew automatically unless canceled at least 24 hours before the end of the current period; you can manage them in your store account settings. Refunds are handled by Apple or Google according to their policies, except where applicable law requires otherwise. Virtual items and in-game currency have no monetary value outside the App and are licensed, not sold, to you.
9. Third-party services
The Services may include links to or integrations with third-party services (such as sign-in, payments, maps or advertising). We are not responsible for third-party services, and your use of them is governed by their own terms and policies.
10. Intellectual property
The Services, including software, design, graphics, text and the “Pusulart Studio” name and logo, are owned by Sonmez LLC or its licensors and protected by intellectual property laws. Except for the license above, no rights are granted to you. If you send us feedback, we may use it without obligation to you.
If you believe content on the Services infringes your copyright, send a notice to [email protected] including the information required by the Digital Millennium Copyright Act (17 U.S.C. § 512).
11. Suspension and termination
You may stop using the Services at any time. We may suspend or terminate your access if you violate these Terms, if required by law, or to protect users or the Services. Sections that by their nature should survive termination (including ownership, disclaimers, limitation of liability, indemnification and governing law) will survive.
12. Disclaimers
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE”. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT, AND ANY WARRANTY THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE OR SECURE.
13. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, SONMEZ LLC AND ITS MEMBERS, MANAGERS, EMPLOYEES AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO THE SERVICES OR ANY TRANSACTION BETWEEN USERS. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE SERVICES IN THE 12 MONTHS BEFORE THE CLAIM OR (B) USD 100. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you. Nothing in these Terms limits rights you have as a consumer that cannot be waived by contract.
14. Indemnification
To the extent permitted by law, you agree to indemnify and hold harmless Sonmez LLC from claims, losses and expenses (including reasonable legal fees) arising from your User Content, your transactions with other users, or your violation of these Terms or the law.
15. Governing law and jurisdiction
These Terms are governed by the laws of the State of Wyoming, USA, without regard to its conflict-of-laws rules. Any dispute arising out of or relating to these Terms or the Services will be brought exclusively in the state or federal courts located in the State of Wyoming, and you and we consent to their personal jurisdiction. If you are a consumer residing in the EU, UK or another country whose laws give you the right to bring claims in your local courts or under your local law, nothing here takes away those rights. Before filing a claim, please contact us at [email protected] so we can try to resolve it informally.
16. Additional terms for Apple and Google
If you downloaded an App from the Apple App Store: these Terms are between you and us, not Apple. Apple is not responsible for the App or its content, has no obligation to provide maintenance or support, and is not responsible for addressing any claims relating to the App (including product liability, legal compliance or intellectual property claims). If the App fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price, if any; Apple has no other warranty obligation. You confirm you are not located in a country subject to a US Government embargo and are not on any US Government list of prohibited or restricted parties. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. Your use of the App must also comply with Apple’s Usage Rules.
If you downloaded an App from Google Play, your use is also subject to the Google Play Terms of Service.
17. General
We may update these Terms from time to time. We will post the updated Terms here with a new “Last updated” date and notify you of material changes where appropriate; continued use means you accept them. If any provision is found unenforceable, the rest remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger or sale of assets. These Terms are the entire agreement between you and us regarding the Services.
